L’articolo illustra il ruolo giocato dall’istituto concessorio all’interno della nozione giuridica di demanio marittimo. A dispetto dei principi di inalienabilità (art. 823, c. I, Cod. civ.) e di “compatibilità” tra uso concesso e pubblico uso (art. 36 Cod. nav.), le facoltà di godimento e disposizione delle pubbliche amministrazioni si sono caratterizzate, fino a tempi molto recenti, per l’assenza di limiti effettivi e di una vincolante predeterminazione dei fini. Questo assetto non è mutato allorché il legislatore ha accolto le proposte della dottrina tendenti all’introduzione di strumenti di pianificazione portuale e costiera: la generale ineffettività di tali previsioni normative, infatti, attesta a tutt’oggi l’indeterminatezza del rapporto tra le nozioni di concessione e di demanio marittimo. Le recenti pronunce del giudice amministrativo riguardano solo indirettamente il tema, ma contengono argomenti utili alla definizione dei suoi aspetti problematici.

Maritime domain and concession: what news from the November 2021 rulings?

The article describes the role played by the notion of concession in the legal framing of maritime State property. In spite of the principles of non-marketability (art. 823, c. I, Cod. civ.) and “compatibility” between private and public use (art. 36 Cod. nav.), the public authorities’ rights of disposal, until very recent times, were characterized by the absence of actual limits and binding predeterminations of purposes. This order has not changed when the legislator has accepted the proposals of the scholars, aimed to the introduction of seaports and ‘coastal’ public property planning instruments: in fact, the general ineffectiveness of such regulatory provisions still today testifies the indeterminacy of the relationship between the notions of concession and maritime domain. The latest rulings of the administrative judge only indirectly concern this topic, although they contain useful statements to the definition of its problematic aspects.
