L’ordinanza in commento rappresenta un fondamentale tassello della giurisprudenza costituzionale non solo in tema di legittimazione attiva dei singoli parlamentari, avendone, per la prima volta la Corte riconosciuto l’ammissibilità, in sede di conflitto di attribuzione tra poteri dello Stato, ma anche con riguardo ai dirompenti effetti arrecati al procedimento legislativo dal ricorso al binomio maxi-emendamenti – questione di fiducia. Rispetto alla tendenziale riottosità manifestata sin dalla sentenza n. 9 del 1959, la Corte, dopo aver mostrato alcuni segni di attenzione nei confronti di tale “problematica prassi”, ha colto l’occasione, nel caso in esame, per condannare le forzature procedimentali da essa derivanti rispetto ai momenti essenziali dell’iter legis come scanditi dai principi costituzionali ex artt. 70 e 72 Cost.

Fiat iustitia ne pereat mundus. A Peremptory Admonishment to Limit the Recourse to the Combination of so-called Maxi-amendments and the Confidence Vote. Comment to the Order n. 17 of 2019 of the Constitutional Court.

First of all, the order in question represents a fundamental piece of constitutional jurisprudence because the Court recognized for the first time the admissibility of the active legitimation of the individual members of the Parliament in a conflict of attributions between powers of the State. Secondly, the order has a fundamental importance with respect to the disruptive effects caused to the legislative procedure by the recourse to the combination of so-called maxi-amendments and the confidence vote. The Court has been traditionally reluctant-since its decision n. 9 of 1959 – to intervene on this issue. It has then sometimes demonstrated to be interested in such “problematic praxis” and, in the order in question, it took the opportunity to condemn the forcing of the procedure that it creates, with respect to essential steps of the legislative procedure, as articulated by the constitutional principles contained in Articles 70 and 72 of the Constitution.
