Nel presente lavoro, l’analisi dell’ordinanza n. 19598 del 2020 delle Sezioni unite della Corte di Cassazione, che dispone un rinvio pregiudiziale alla Corte di Giustizia dell’Unione europea, viene declinata sotto una doppia visione prospettica: da una parte, si cerca di coglierne i riflessi interni in tema di tutela giurisdizionale, partendo dai principi costituzionali sul tema e dalla loro evoluzione alla luce della giurisprudenza costituzionale; dall’altra, si tenta di ricostruirne le conseguenze sui rapporti tra le Corti interne (Corte costituzionale e Corte di Cassazione) e Corti esterne (Corte di Giustizia dell’Unione europea) e, dunque, sulle evoluzioni del complesso dialogo esistente tra le stesse.

Jurisdiction, Constitution and Courts: Retrospect and Perspective. About a Recent Preliminary Reference to the Court of Justice of the European Union

In the present work, the analysis of Ordinance no.19598 of 2020 of the Joint Sections of the Court of Cassation, which provides a preliminary reference to the Court of Justice of the European Union, is declined under a double perspective: on the one hand, an attempt is made to grasp the internal reflections on the subject of judicial protection, starting from the constitutional principles on the subject and their evolution in the light of constitutional jurisprudence; on the other hand, an attempt is made to reconstruct the consequences on the relations between the internal Courts (Constitutional Court and Court of Cassation) and external Courts (Court of Justice of the European Union) and, therefore, on the evolution of the complex dialogue existing between them.
