Il contributo esamina e commenta l’ordinanza n. 632 del 2020 con cui il Tribunale di sorveglianza di Firenze ha riconosciuto il diritto all’assegnazione ad un reparto femminile in capo ad una detenuta che aveva ottenuto la rettificazione dell’attribuzione di sesso in assenza della modificazione dei caratteri sessuali maschili primari. Nell’affrontare il tema della tutela dell’identità di genere nel contesto penitenziario l’Autrice si sofferma, tramite la lettura di alcune pronunce della Corte EDU, della Corte di Cassazione e della Corte costituzionale, sulla complessa tematica del mutamento di sesso e dell’(ir)rilevanza dell’intervenuta modificazione chirurgica dei caratteri sessuali ai fini della rettificazione anagrafica.

Gender Identity and Protection of Human Dignity behind Prison Walls. Reflections on a Recent Ruling of the Supervisory Court of Florence, Italy

The paper examines and reviews ruling n. 632 of year 2020 by which the Supervisory Court of Florence granted an inmate, who had previously obtained the rectification of sex attribution, the right to be assigned to the female ward of her prison, despite the fact that she retained her male primary sexual characteristics. Addressing the subject of gender identity in correctional environments, the Author focuses on the complex topic of sex change and the (ir)relevance of sex reassignment surgery in order to obtain sex rectification, reviewing various rulings of the European Court of Human Rights, of the Court of Cassation and of the Constitutional Court.
